RIGHT OF WITHDRAWAL

  • Purchases made on the Webdivino.it website are governed by Italian Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, which grants the consumer the right to withdraw from the purchase contract for any reason.

  • the consumer wishing to exercise this right should note that the purchased item must be completely intact in order to do so

  • in order to exercise this right, the consumer must fill in the form below, entering the email address used to place the order and the order number; once the order has been identified, the consumer will be able to select the products for which they wish to withdraw from the contract and request a refund, submitting the return declaration. An immediate confirmation email will be sent, including a reference number for the return declaration. This confirmation email, with its date and time, constitutes the legal confirmation of the exercise of the right of withdrawal.



  • the right of withdrawal is reserved solely for the end consumer, understood as a natural person, and does not extend to purchases made by parties buying for resale to third parties.

  • return shipping method and costs are entirely at the customer's expense, including any packaging suitable for the return. In the case of returns from non-EU countries, any customs charges for bringing the goods back into Italy are the customer's responsibility.

  • Webdivino.it reserves the right to inspect the goods sent to us in order to rule out any alteration, damage, tampering or any other issue that may have compromised the integrity of the item.

  • If the right of withdrawal is exercised following the procedures and terms indicated in this article, the Seller undertakes to refund all Payments received from the Consumer Customer as soon as possible and in any event within 14 days from the date of receipt of the withdrawal notice. The Seller may withhold the refund until the Product has been received, or until the Customer has provided proof of having returned it, whichever occurs first. The refund will be issued, once the full integrity of the item has been verified, within 14 calendar days. The customer will be refunded using the same method as the original payment (credit card, PayPal, bank transfer, AmazonPay); where this is not possible, the refund will be made by bank transfer.
  • The Consumer Customer will only be liable for any decrease in the value of the Product resulting from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the Product.
  • The right of withdrawal is excluded in the cases set out in Article 59 of Legislative Decree No. 206/2005 and subsequent amendments. By way of example and not limitation, the following are cases in which the right of withdrawal referred to in the previous article is excluded: the supply of goods liable to deteriorate or expire rapidly; the supply of sealed goods which are not suitable for return for hygiene reasons or reasons connected with health protection and which have been opened after delivery; the supply of alcoholic beverages, the price of which was agreed at the time the sales contract was concluded, delivery of which can only take place after thirty days, and whose actual value depends on fluctuations in the market which cannot be controlled by the seller.


DISPUTES AND COMPETENT COURT

The sales contract between the customer and Webdivino.it is deemed to be concluded in Italy and is governed by Italian Law. Any matter relating to the Contracts shall be subject to Italian jurisdiction. In the case of a Consumer Customer, for all disputes arising from this contract, including those relating to its validity, interpretation, performance and termination, exclusive territorial jurisdiction lies with the court of the place where the consumer resides or is domiciled.


ONLINE DISPUTE RESOLUTION FOR CONSUMERS

Consumer Customers residing in the European Union are informed that the European Commission has established an online platform providing an alternative dispute resolution tool. This tool can be used by European consumers to resolve, out of court, any dispute relating to and/or arising from online sales contracts for goods and services. This platform can be used to resolve any dispute arising from the online contract entered into. The platform is available at the following link: http://ec.europa.eu/consumers/odr/
